Business litigation and disputes can quickly develop for many reasons, including but not limited to:
- Contract disputes
- Breach of contract
- Partnership disputes
- Disputes between owners of an LLC
- Shareholder disputes and Oppression of Minority Shareholders
- Breach of fiduciary duty
- Payment disputes
- Misappropriation of trade secrets, intellectual property and proprietary information
- Non-compete violations
- Fraud, theft or commingling of assets
- Employment disputes
- Sales contract or service agreement disputes
In many cases, the high cost and time associated with business litigation cases discourages business owners from filing law suits for legitimate purposes. The reality of business disputes and business litigation cases is most lawsuits and disputes are resolved through effective negotiation long before they reach trial. Our clients want to accomplish their objectives for the dispute in the shortest possible time frame and in a cost-effective manner. The fastest and most effective way to resolve a business dispute is leveraged negotiation.
Our experienced lawyers work to quickly assess the underlying contract(s) and the initial position of each party. We work to ascertain the damages associated with the dispute which provide the leverage necessary to gain the attention of other parties and draw them into constructive negotiations.
Mediation and Arbitration
Mediation and arbitration are two effective alternatives to business litigation and lawsuits. However, it is not in your best interests to enter a mediation, and certainly not an arbitration without expert legal representation. The attorneys at Dodd & Dodd Attorneys, PLLC have decades of experience and expertise representing clients in mediation. It is important to have legal representation in mediation and arbitration in Louisville and throughout Kentucky to ensure you receive the perspective, advice and guidance to influence a positive outcome. In a mediation, the proceedings are led by a neutral third party who is agreed upon by the participants. The “mediator” is selected because they possess a thorough understanding of the issues in dispute, as well as strong negotiation and mediation skills. The mediator will help both parties to get to the core issue(s) of the dispute, provide recommendations and suggest alternative solutions to resolve the dispute. The parties are not bound to implement the recommendations of the mediator.
Our attorneys maintain a strong degree of control and influence on behalf of our client throughout the mediation process. We contribute our expertise as well as the benefit of our decades of experience in similar cases. Mediation can be a cost-effective and timely alternative to arbitration or litigation.
Arbitration is an alternative to trial which is required by many business contracts. Arbitration in Kentucky is a highly structured legal environment, however it is not bound by many of the standard rules of evidence or processes. The arbiter has much more power than a mediator, and the ruling of the arbiter is considered “binding” in most situations.
No one should enter into an arbitration without expert legal representation. As your attorneys in arbitration, we provide an initial brief to the arbiter outlining our position and the strengths behind it. Our attorneys are skilled trial experts, and these skills come into service during the collection of testimony and when presenting arguments before the arbiter. The ruling of the arbiter is usually considered binding, and can only be challenged in rare cases where fraud or collusion can be proven.
