Does a Child Choose Who They Want to Live With After a Divorce

Does a child choose who they want to live with after a Louisville divorce?  How much weight will a Judge give to the expressed wishes of each child? A common misconception is once a child reaches the age of 14 they can simply choose which parent they want to live with.  This is simply not the case.

The Court is interested in the best interests of the child, first and foremost.  Multiple long-term studies have shown it is in the best interest of a child to spend an equal amount of “quality time” with each parent as part of the child custody and visitation plan during and after a divorce.  This is obviously not going to be the case when serious issues such as drug or alcohol abuse, domestic violence or criminal activity are issues in the case.  When does a child choose who they want to live with during and after a Louisville divorce?

The Court will listen to the input and perspectives of any child who is old enough and mature enough to communicate a reasoned position when it comes to how much time they spend with their parents.  The Court’s principle objective is to put each child in the best position to adjust to recent changes and ultimately thrive.  The Court will also consider any undue attempts by either parent to influence the child in this regard.

There are many factors which go into child custody and visitation cases.  One must consider the existing rhythms of each child’s life such as school, the support of family and friends, religious practices, special needs and even extra-curricular activities.  The Court will give serious consideration to the child’s wishes, especially when they have entered maturity (often considered to be the age of 14).  The child’s point of view is a serious factor, but there are usually several important issues to balance when considering a child custody and visitation plan.
