Who Should Give Serious Consideration to a Prenup in Louisville

Who should give serious consideration to a prenup in Louisville?  What is a prenuptial agreement?  Why is there such a negative atmosphere around prenuptial agreements and what is the truth about a prenup?

First things first.  You should give serious consideration to a prenup in Louisville if you are considering marriage and one of you earns substantially more than the other or has significant assets or trust income.  Business owners and those already in professional practice (licensed professionals) should also weigh the advantages of a prenup.

A prenuptial agreement is simply a contract between two parties prior to a marriage.  A prenuptial agreement establishes the “separate” property (such as a business, trust fund, investments, real estate) of one or both of the parties and clearly protects that ownership for the future.  A sound prenuptial agreement should candidly establish the situation at hand and lay out plans and expectations for how these finances and assets will be held and managed during the marriage.  The prenup should also protect the original owner’s interest in the asset(s) or funds and keep it separate from the “marital” established by a marriage.

You should give serious consideration to a prenup in Louisville if either of you have substantial assets or debts, such as student loans.  Prenuptial agreements have a negative atmosphere around them in the general public and the typical objection to a prenup is: “Aren’t you just planning for a divorce?”  Nothing could be farther from the truth.

As Louisville family law attorneys with decades of experience in all aspects of family law including prenuptial agreements and divorce we can tell you one thing for certain: one of the best predictors of a good marriage is the ability of the couple to openly and honestly acknowledge facts, discuss difficult topics, work through challenges and areas of disagreement and find common ground.  If you don’t have this kind of relationship perhaps you should give serious consideration to the proposition of marriage.

Marriage is amazing, wonderful, fulfilling and everything you can dream of.  It can also be quite challenging as each spouse experiences growth and setbacks at different points and the parties must work together to navigate their life together. We invite you to review the strong recommendations of our former clients and contact us or call 502-584-1108 to schedule an appointment with one of our experienced divorce and family law attorneys.
