How to Reduce the Odds of Post Divorce Decree Litigation

How to Reduce the Odds of Post Divorce Decree Litigation

Are you wondering how to reduce the odds of post divorce decree litigation in Louisville family law courts?  You have learned the process of a divorce is very challenging.  There are many issues where you and your former spouse have substantial disagreement.  The question isn’t only “How can we get things resolved and complete a divorce?”  It should be “How can we resolve all the issues on which we presently disagree and reduce the odds of post divorce decree litigation in our case?”

You don’t want to have to go through all of this, and then two or three years down the road wind up back in court for an expensive and time-consuming post decree modification hearing.

When a couple takes a dispute in a divorce before a Louisville family court the matter is resolved by a total stranger – the judge.  It is important to understand that Louisville family law judges do not issue a “Win” or “Lose” decision in the vast majority of these cases.  The judge is looking for a fair and just resolution.  This means neither party will get everything they want and both parties will leave the proceedings feeling like they’ve literally been punched in the stomach.  Unfortunately, both parties in these cases feel the decision was arbitrarily forced upon them.   Many recent studies have shown imposed judgments lead to increased post-decree disputes as neither party is satisfied with the outcome.

The good news is its absolutely possible to reduce the odds of post divorce decree litigation.  The studies have shown former spouses who (in effect) work together to resolve their differences, either through negotiation or in a forum such as mediation, are much more likely to abide by the agreements they’ve reached.  In other words, when an agreement is reached between the parties in negotiation or mediation, the parties themselves have more skin in the game and are much more likely to follow the agreement they personally contributed to.
