Is Mediation a Good Strategy in a Louisville Divorce?

Is Mediation a Good Strategy in a Louisville Divorce – Proven Counsel

What is mediation and is mediation a good strategy in a Louisville divorce?  Mediation is a cost effective and timely alternative to resolving differences in a Louisville divorce, child custody & visitation, child support, maintenance or family law dispute through litigation in a Court of Law.

Mediation is designed to bring the parties in a family law dispute together in an atmosphere designed to foster cooperation and collaboration. The parties agree upon an expert independent third-party mediator who works to help each party to understand all of the issues surrounding the challenge at hand while seeking a resolution to allow settlement of the matter.  Mediation is designed to work through hardened emotions and positions to find alternative solutions based upon Kentucky Family Law and the unique circumstances of the parties.

The recommendations of your mediator are not binding.  They are usually based upon a little give-and-take which offers resolution of the issue(s) while allowing the process of the divorce to move forward.  Clients in mediation enjoy a much higher degree of influence and control over the outcome.  The parties have participated in the process of crafting an agreement.  It is important to note that agreements reached in mediation have been proven in many studies to substantially reduce the likelihood of future litigation.  These are some of the reasons which make mediation a good strategy in a Louisville divorce case.

When an issue cannot be resolved outside of Court, the Judge listens to the parties and reviews evidence before imposing a solution.  Your future (and that of your family) in this scenario lies in the hands of a total stranger, the Judge.  In Court there are rarely “winners” or “losers” as the Judge will attempt to craft a fair and reasonable resolution that most often leaves both parties feeling disappointed.

Mediation on the other hand leaves the parties feeling empowered and satisfied.  Another benefit which makes mediation a good strategy is it can help to teach the parties important skills about resolving differences and working together which help the parties to learn to communicate more effectively down the road.  This serves each individually, as well as any working relationship such as co-parenting after the divorce is completed.

The “tone and experience” of your divorce will have a substantial impact on you not only during the divorce but in the months and years following its completion.  Mediation establishes a better tone and experience, setting up the parties for a more successful life after divorce.
