Request Modification of Child Support After a Louisville Divorce

Do you need to request modification of child support after a Louisville divorce?  How are existing child support orders modified and what is required for a change to occur?

Child support is usually based upon specific guidelines established by the State’s formula and/or an agreement between the parties.  Once an order for child support has been issued by the Court there are generally two ways to modify it: agreement between the parties or petition the Court to request modification of child support after a Louisville divorce.  If the parties are in agreement you simply need our attorneys to draft an agreement, sign it and submit it to the Court for review and approval.

Unfortunately, our Family Courts are still quite backlogged after the pandemic.  In order to request a hearing to modify child support, the Court will require a significant change in the “Status Quo.”  There are several events which should qualify as a significant change in the status quo.  If the income of the payor or the recipient increases or decreases by more than 10% the Court may agree to revisit existing child support orders.  In many cases, child support also reflects the amount of time each parent spends with each child.  Perhaps a change at work means the payor is able to spend more time co-parenting the child(ren).  This could warrant not only the need to request modification of child support after a Louisville divorce, but child custody and visitation orders as well.
