Grandparents Rights

Louisville, Kentucky, Grandparent Rights Lawyers

“Grandparents’ rights” is a growing body of law addressing the rights of grandparents in custody and visitation cases.  The concept of Grandparents Rights applies primarily to visitation with a grandchild.  Kentucky Courts may grant grandparent visitation if clear and convincing evidence is presented showing that grandparent visitation is in the best interest of the child.

This area of law also involves the defense against grandparents’ rights for parents who are involved in a dispute. At Dodd & Dodd Attorneys, PLLC, we offer strategic and experienced advocacy to both grandparents seeking custody or visitation rights and in the defense of grandparents’ rights cases.

We routinely use therapists and other experts to help advocate for our clients’ positions. Contact us for more information about grandparents’ rights.

What are Grandparents Rights?

Grandparents rights involve grandparents asserting rights to custody or visitation to a grandchild. Many grandparents will pursue a case when a family dispute causes a parent to prevent the grandparent from seeing a grandchild.  Grandparents may also become involved if they are prevented from seeing their grandchildren due to a contentious divorce, the death of their son or daughter or other situations that may lead to estrangement.  A grandparent may need to step in legally and seek physical custody if they feel that a child’s well-being is threatened by neglect, abuse, or drug or alcohol addiction.

Can I get Visitation Rights to see my Grandchild in Kentucky?

In Kentucky, visitation may be granted to grandparents if the Court determines by clear and convincing evidence that grandparent visitation is in the child’s best interests although this can be a difficult legal hurdle to meet.  It is incredibly important to have a skilled attorney show the Court the importance for a child to spend quality time with loving grandparents.  It is unfortunate that some parents attempt to use their children as pawns in a dispute with their child’s grandparents.  Our attorneys will work with necessary professionals, interview witnesses and present all evidence needed to support your case to see your grandchildren. We will help you present your case to the Court that it is in the best interests of the child to have contact and visitation with you.

Can I get Custody of my Grandchild?

A grandparent who has been a primary caretaker of a child for a certain period of time, depending on the child’s age, may be able to obtain the same child custody and visitation rights as a regular parent. In other child custody and grandparents rights cases, the court will consider the wishes of parents and children, the relationship between the child and parents, the child’s adjustment to their home, school and community and the mental and physical condition of all persons involved.
