What Should You Consider Before Moving Out During a Louisville Divorce

What Should You Consider Before Moving Out During a Louisville Divorce

What should you consider before moving out during a Louisville divorce?  It is quite natural for the parties to begin to separate their lives from one another while pursuing a divorce.  However, it is important for you to realize that moving out of the family home can absolutely affect your best interests when it comes to your own goals and objectives for the divorce.

This is especially true if you have children and wish to share custody and parenting time.  Leaving the home (and by extension the children) can be construed as evidence against your fitness or seriousness when it comes to parenting the child(ren).  It is also very possible for the remaining parent to limit access to the children before an agreement can be reached regarding custody and parenting time.  Therefore one of the things you should consider before moving out during a Louisville divorce is the potential contentiousness of parenting issues in your divorce.  It is best to wait until orders have been issued by the Court or an agreement between the parties has been reached in negotiation or mediation.

One of the most obvious things to consider before moving out during a Louisville divorce is the financial impact it can have on your life and that of any children.  Is purchasing a new home or renting the best use of your available resources at this time?  Even if money is virtually unlimited, decisions taken in the midst of stress and other distractions are rarely good decisions.

During the decades of our experience as divorce and family law attorneys in Louisville we have seen it all.  Locks are changed to prohibit access.  Assertions of abandonment (while perhaps irrelevant in a divorce proceeding) can have an impact on relationships with children and even affect issues such as maintenance and child support.  There are many things to consider before moving out during a Louisville divorce.  Is this really in your best interests at this time?
