Learn More about an Uncontested Divorce in Louisville - Family Lawyers

A couple looking for an uncomplicated approach to the dissolution of a marriage may find that an uncontested divorce in Louisville is a possibility to consider. However, it is important to understand that there are limitations to the process and this is why it is important to speak with a member of our experienced divorce and family law legal team.

One of the primary requirements for an uncontested divorce in Louisville is that both parties are in complete agreement that the marriage has suffered an “irretrievable breakdown” and that the former spouses agree to every item contained within the separation agreement.

An “irretrievable breakdown” is often referred to as irreconcilable differences.

The separation agreement includes, but is not limited to:

The spouse filing for an uncontested divorce in Louisville must meet Kentucky’s minimum residency requirements: to have lived in the State of Kentucky for the past 180 days prior to filing for the uncontested divorce.  The parties must be “living apart” for at least 60 days prior to filing.

Living apart in this context does not necessarily mean separate homes.  Our attorneys can help to make sure you understand and meet these requirements.  Generally speaking, the parties must be sleeping in separate bedrooms and avoid any intimate or sexual contact.  “Living apart” also means paying your portion of the bills separately from your former spouse.

If the woman is pregnant, divorce proceedings in Kentucky cannot proceed until after the baby is born.
