What are the Options for Visitation Orders in a Louisville Divorce?

What are the options for visitation orders in a Louisville divorce and how can you protect your own child custody and visitation goals and objectives?  Any conversation on child custody visitation in a Louisville area divorce will focus upon the two types of custody established by our Family Code: physical custody and legal custody.  Physical custody relates to the ability to have your child(ren) live with you in your home and to have them with you, as well as the right to pick them up from school, daycare, etc.  Legal custody involves the right to make important decisions in the life of each child related to their upbringing, health, education and overall welfare.

Custody orders can be quite separate from “visitation.”  There are four basic options for visitation orders in a Louisville divorce case:

Scheduled Visitation is one of the most common types of visitation orders in a Louisville divorce and is based upon a specific schedule of the times and dates each child will spend with each parent.  This includes everything from “normal” times during the school year to birthdays, holidays, vacations and special moments in the child’s life.

In cases where the co-parents have established their ability to work together for the best interests of each child in the Court’s eye, an order of Reasonable Visitation provides the co-parents with the flexibility to work out either a specific schedule or leave things a bit more open and free-flowing.

If the Court is concerned about issues of abuse or domestic violence, drug and alcohol abuse or neglect the Judge may order Supervised Visitation. This requires the presence of another adult specified by the Court and often limitations on location and time frame.

In the rare instance the Court believes it is not safe or in the best interests of a child to visit with a parent the Court can order No Visitation.

While there are many options for visitation orders in a Louisville divorce the outcome of the child custody and visitation process in your divorce will depend upon the actions (or inaction) of the child’s parents.  Are you concerned about protecting visitation and custody of your children?  It is absolutely possible to improve your position as a potential co-parent or to damage your own viability for custody and visitation.
