What is a Bifurcated Divorce in Louisville

What is a Bifurcated Divorce in Louisville – Legally Single Prior to Divorce?

What is a bifurcated divorce in Louisville and is this something you wish to consider as part of your divorce case?  One of the obvious outcomes of any divorce is the parties are no longer married to one another and are free to marry someone else under the eyes of the law.  What if you could legitimately and legally seek a change in your legal status from “married” to “single” before the process of your divorce is complete?  Is this in your best interests?

A bifurcated divorce in Louisville essentially splits the legal case of a divorce into two separate processes.  The Court may agree to set aside specific issues as a separate matter while granting the end of the marriage prior to the resolution of every issue within the divorce itself.

In order to consider a bifurcated divorce in Louisville the law requires the parties to wait for the six month period of time established in Kentucky Family Law (six months must pass from the date the respondent is served until the date the divorce can be final).  However, many divorce cases can take more than a year or more to complete.  In some cases, one or both of the former spouses may have a sound reason for wanting to end the underlying marriage as soon as possible, even if every specific detail of the divorce itself is not completed.

In a bifurcated divorce in Louisville the Court can agree to separate the legal status of marriage from one or several unresolved matters including but not limited to child custody and visitation, issues of support, property characterization and division, valuation and disposition of a business interest or even the validity of a prenuptial or postnuptial agreement.

Bifurcation is not a sound strategy in many cases.  This is why it is important to discuss your specific circumstances with the proven, experienced divorce and family law attorneys at Dodd & Dodd. We invite you to review the strong recommendations of our former clients and contact us or call 502-584-1108 to schedule an appointment with one of our experienced divorce and family law attorneys.
