Compel Your Former Spouse to Pay Your Legal Fees in a Louisville Divorce

Former Spouse to Pay Your Legal Fees in a Louisville Divorce

Can you compel your former spouse to pay your legal fees in a Louisville divorce?  Who determines how the costs associated with a divorce are to be paid?  Generally speaking, in most cases the Judge will order each party to pay their own attorneys.  However, there are absolutely genuine reasons to ask for the Court to order your former spouse to pay a portion or a substantial part of your own legal expenses.

What are a few examples of situations where the Court may order your former spouse to pay your legal fees in a Louisville divorce?  One of the obvious examples is when there is a substantial economic imbalance between the parties such as in the case of a stay-at-home parent.  The Judge can issue orders for specific funds to be set aside to ensure a level financial playing field between the parties.

Another example of cases where the Court may order your former spouse to pay your legal fees in a Louisville divorce involves cases of purposefully delaying or dragging out a case unnecessarily which can naturally increase associated the expense of your divorce.  If the Judge in your matter considers your former spouse to be acting in bad faith the Court can issue orders for that party to pay a relevant portion of your own expenses.

This can be the case when a party attempts to hide or misrepresent assets, makes substantially false allegations, fails to comply with discovery or information disclosure orders, misses mediation or court dates or simply refuses to negotiate.  The Court has the authority to order your former spouse to pay your legal fees in a Louisville divorce or a portion of increased fees you would not have had to pay if your former spouse had not acted in bad faith.
